Welcome to ForeverHer. These Terms of Service ("Terms") govern your access to and use of the website, platform, telehealth services, and related products offered by FOREVERHER, INC ("ForeverHer," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Eligibility
To use ForeverHer services, you must:
- Be at least 18 years of age
- Be a legal resident of the United States
- Be biologically female or identify as female and seek women's health services
- Be capable of forming a binding contract under applicable law
- Not be a person barred from receiving services under the laws of the United States or any applicable jurisdiction
By using our services, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone at our sole discretion.
2. Account Terms
To access certain features of our platform, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and complete
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You may not share your account credentials with any third party. We reserve the right to suspend or terminate accounts that we believe are being used in violation of these Terms.
3. Telehealth Services
ForeverHer provides telehealth consultations connecting you with licensed healthcare providers. By using our telehealth services, you acknowledge and agree that:
- Telehealth consultations are not a replacement for in-person medical care and do not establish an ongoing provider-patient relationship beyond the scope of the consultation
- Our providers will use their independent medical judgment to determine whether our services are appropriate for you
- A provider may decline to prescribe or recommend treatment if, in their professional judgment, it is not medically appropriate
- You will provide truthful and complete health information during consultations
- Our services are not intended for medical emergencies — if you experience a medical emergency, call 911 or go to the nearest emergency room
- The availability of telehealth services may vary by state based on licensing and regulatory requirements
4. Prescription Services
Certain ForeverHer products require a valid prescription from a licensed healthcare provider. Regarding prescription services:
- All prescriptions are issued at the sole discretion of the prescribing provider based on their clinical evaluation
- Prescriptions are filled through licensed, FDA-compliant compounding pharmacies
- We do not guarantee that any particular treatment will be prescribed
- You agree to follow all usage instructions, dosing guidelines, and safety information provided by your prescribing provider and included with your medication
- You must report any adverse reactions or side effects to your provider promptly
- Prescription products are for your personal use only and may not be shared, sold, or transferred
- Refills are subject to ongoing clinical review and provider approval
5. Payment Terms
By purchasing products or services through ForeverHer, you agree to the following payment terms:
- All prices are listed in U.S. dollars and are subject to change without prior notice
- Payment is due at the time of purchase unless otherwise specified
- You authorize us to charge the payment method on file for all applicable fees
- Subscription services will automatically renew at the then-current rate unless you cancel before the renewal date
- You may cancel subscriptions at any time through your account settings; cancellation takes effect at the end of the current billing period
- Refunds are handled on a case-by-case basis at our discretion, except where required by law
- ForeverHer services are generally not covered by health insurance; you are responsible for all costs
- We use third-party payment processors and do not store your full payment information on our servers
6. Intellectual Property
All content, materials, trademarks, and intellectual property on the ForeverHer platform are owned by or licensed to FOREVERHER, INC. This includes but is not limited to:
- The ForeverHer name, logo, and brand identity
- Product names, treatment names, and associated brand identity elements
- Website design, text, graphics, images, and software
- Educational content, marketing materials, and documentation
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our intellectual property without our prior written consent. Limited personal, non-commercial use of our website content is permitted for informational purposes.
7. User Conduct
When using ForeverHer services, you agree not to:
- Provide false, misleading, or inaccurate health or personal information
- Use the platform for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any portion of the platform, other accounts, or connected systems
- Interfere with or disrupt the integrity or performance of the platform
- Use automated systems, bots, or scripts to access the platform without our prior written consent
- Resell, redistribute, or commercially exploit our products or services
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload or transmit viruses, malware, or other harmful code
- Harass, abuse, or threaten our staff, providers, or other users
8. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY
- WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE
- WE DO NOT GUARANTEE ANY SPECIFIC HEALTH OUTCOMES OR RESULTS FROM OUR PRODUCTS OR SERVICES
- INDIVIDUAL RESULTS MAY VARY AND DEPEND ON NUMEROUS FACTORS INCLUDING YOUR OVERALL HEALTH, ADHERENCE TO TREATMENT PROTOCOLS, AND BIOLOGICAL RESPONSE
- THE INFORMATION ON OUR PLATFORM IS FOR EDUCATIONAL PURPOSES AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOREVERHER, INC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES
- ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
- ANY DAMAGES ARISING FROM STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OUR PLATFORM
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE AMOUNT YOU PAID TO FOREVERHER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless FOREVERHER, INC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of or access to our services
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content or information you provide through our platform
- Your misuse of prescribed products or failure to follow medical guidance
11. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or our services shall be resolved as follows:
Informal Resolution
Before initiating any formal proceedings, you agree to first contact us through our website to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any dispute within thirty (30) days of receiving your notice.
Binding Arbitration
If informal resolution is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall be conducted in the State of Delaware. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against FOREVERHER, INC.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
13. Termination
We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use our services ceases immediately
- We may delete your account and associated data, subject to our data retention obligations and applicable law
- Any outstanding payment obligations remain in effect
- Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 8, 9, 10, 11, and 12
You may terminate your account at any time by contacting us through our website or through your account settings.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or through our platform. Your continued use of our services after any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our services.
15. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it in the future.
- Entire Agreement: These Terms, together with our Privacy Policy, Telehealth Consent, and Health Data Privacy Policy, constitute the entire agreement between you and ForeverHer regarding your use of our services.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, government actions, or interruptions in telecommunications or internet services.
